Terms and Conditions of Sale

Payment Terms:

• NET 30 days from invoice date.

Freight Terms:

• FOB Better Way Design's place of shipment.

Technical Data:

• Technical specifications and/or drawings provided by Better Way Design shall remain the property of Better Way Design and may not be used or duplicated without the written permission of Better Way Design.

Defective Goods:

• Any goods claimed to be defective shall not be returned by Purchaser without prior consent of Better Way Design.
• Goods will not be accepted by Better Way Design for credit replacement after 90 days of shipment.
• Goods will not be accepted for replacement or credit if found altered or misused by any one other than Better Way Design.

Loss or Damage:

• Goods damaged in transit are the responsibility of the Carrier. Claims should be filed with the delivery transportation company.
• Claims for shortage and lost shipments must be made in writing to Better Way Design within 21 days from the date of shipment.

Taxes:

• All local, state, and federal sales and excise taxes, if any, are to be paid by the Purchaser.

Liability:

• Better Way Design's liability shall be expressly limited to the repair or replacement of unaltered or returned goods found by Better Way Design to be defective.
• Downloads, such as drawings and files, are available for use as a DESIGN REFERENCE ONLY.

Termination:

• Purchase orders accepted by Better Way Design may only be cancelled or modified with the consent of Better Way Design.
